Man had sex with drunk 15-year-old girl

A man who took advantage of an underage girl by having sex with her when she was drunk has been given a suspended prison sentence.

A friend had told Joseph Derek Bailey, then 20, that the girl was 15, and warned him “not to do anything sexual with her”, said Andrew Espley, prosecuting.

But after she had drunk a small bottle of vodka and other drinks, he had sex with her at their second meeting.

For Bailey, Susannah Proctor said he had had to move out of York as a result of the sexual encounter.

When his friends heard about what he had done, they had distanced themselves from him.

He had moved to Scarborough where he had started a new life with a new job.

“He does show significant remorse for this offence,” she said. “He didn’t appreciate how drunk she was at the time.”

Bailey, now 21, formerly of Acomb and Selby, pleaded guilty to sexual activity with a child.

Judge Simon Hickey told him: “You didn’t ply her with alcohol, but you took advantage of a drunk girl.

“You were the older and an adult, you should have drawn back. It has to be custody.”

He suspended the 12-month prison sentence for two years on condition that Bailey completes a 33-session sex offenders’ rehabilitation course and does 15 days’ rehabilitative activities.

He also put him on the sex offenders’ register.
