Pensioner locked up for ‘desperately humiliating’ sexual abuse of girl

A pensioner has been jailed after intimately touching a young girl in a “desperately humiliating” way.

He was a “bully” and his violence had “blighted her life”, a court heard.

Former lorry driver Derek Smith, 70, of St Michael’s Road, Grimsby, was convicted by a jury of two offences of indecent assault and another of child cruelty.

He was cleared of six other offences and acquitted of two more on the direction of the judge.

Megan Rhys, prosecuting, told Grimsby Crown Court that Smith’s behaviour had a significant effect on the girl’s physical and mental health.

“She remains frightened of him to this day,” said Miss Rhys.

“She is always looking round to see if he is there.”

Judge Mark Bury said that Smith intimately touched the girl in a “desperately humiliating” way.

He was also physically abusive and kicked and punched or slapped her, although no injuries were caused.

“That just shows that you were a bully,” said Judge Bury.

During a display of “poor temper”, Smith took a phone off the girl and slapped her on the face with it, causing a chipped tooth. He also kicked her.

“She has suffered throughout her life with various aspects of her life,” said Judge Bury.

“She is living her life with the effects of what you did uppermost in her mind. It has blighted her life.

“You have been cowardly. As time has gone on, it has badly affected her.

“These offences are so serious that only an immediate sentence of imprisonment can be imposed.”

Smith was jailed for three and a half years and must register as a sex offender for 10 years.
