Pervert jailed for sex assault, indecent images of children and voyeurism
A 59-year-old who took photographs of a young girl taking a shower and was later found with pictures of three young children in a bath has been jailed for 21 months.
Marian Swierzy of Holly Close, Taunton, appeared before Judge David Evans at Taunton Crown Court on Monday (July 3) after admitting two charges of sexual assault, one of possession of indecent images of children and one of voyeurism.
Prosecuting, Raymond Tully, told the court that one of his three victims told police she had been made to feel uncomfortable by the way he touched her and tried to have inappropriate conversations with her.
“He asked her about french kissing, boyfriends, and used some very inappropriate language,” he said.
“He put his hand on her thigh and when she told him she didn’t like it and wanted him to stop, he gave her a ‘death glare’,” he said.
When arrested by police in March 2016, Swierzy said he had an interest in photography and had taken the photographs of a girl in a shower because of their “artistic merit”.
Police took a number of devices from his home and uncovered 12 images classed as Category C, including images of the three children in the bathtub.
Swierzy claimed to have permission to photograph them – something which turned out to be a lie. The images dated back to 2012.
Sentencing him, Judge David Evans said: “You had a sexual interest in the girls, and that attraction increased and you began to engage in inappropriately sexual conversations with a girl, in front of two younger girls.
“You touched her in an unmistakably sexual manner and when she asked you to stop, you gave her a ‘death glare’ – a clear attempt to intimidate a young girl into letting you do what you want.
“Your interest in her was not normal and your behaviour has left a legacy of upset and persistent anxiety.
“You took photographs and you denied there was anything sexual about them, asserting – as you continue to do – that it was all about photography. You kept those images for some time, showing a clear sexual attraction to the girls.
He sentenced Swierzy to eight months for the two sexual assault charges, to run concurrently, 10 months for the possession of indecent images and three months for voyeurism, to run conseculatively.
The total sentence was 21 months in prison, and was made the subject of a sexual harm prevention order.
He will also be on the Sex Offenders’ Register for 10 years.
